Immigration to the United States can seem like a daunting maze, through which one cannot travel. Our goal is to help our clients achieve their American dream, and to make the process as transparent as possible. There are several ways in which one can emigrate to the United States. Below are some examples of these avenues, and our services.

Employment Sponsorships
The H1B is a non-immigrant visa category that allows American companies and universities to temporarily employ foreign workers who have the equivalent to a US Bachelor’s Degree. A specialty occupation is one that requires theoretical and practical application of a body of specialized knowledge along with at least a bachelor’s degree or its equivalent.

L1 intra company business visa allows managers, executives and specialized knowledge employees to transfer from a foreign company to a US parent, affiliated, or subsidiary branch to perform temporary jobs.

Extraordinary Ability Visas
The O-1 Visa is for persons of extraordinary ability. The visa enables people with extraordinary ability in the sciences, arts, education, business, athletics, motion picture or television industry to enter the U.S. for temporary periods of time.

To be considered a person of extraordinary ability, you should be considered to be at the top of your field, and can only work in the US in that area of expertise.

O-1 status can be granted initially for up to three years, depending on the length of the employment event which requires the foreign national’s services. Although O-1 status can be extended, extensions are generally only granted in one-year increments.

Your spouse and unmarried children under the age of 21 may join you in the US under O-3 status. Although they may not work while in the U.S., family members are allowed to attend school.

Family Sponsored Immigration
Family based immigration is just one of the ways of obtaining a Lawful Permanent Resident status in the United States. Although, there are some hurdles that exist along the way that families must overcome, it remains to be one of the fastest and easiest ways of becoming a Lawful Permanent Resident.

There are four categories of family sponsorships:

  • for unmarried sons and daughters of United States citizens;
  • for spouses and unmarried sons and daughters of Lawful Permanent Residents;
  • for married sons and daughters of United States citizens;
  • for the siblings of over age 21 of United States citizens.

Grandparents, aunts, uncles, in-laws and cousins cannot sponsor a relative for immigration. There is also a numerical limitation to the number of family based visas granted each year. Therefore, in each category, the application date becomes the priority date of the petitioner.

Family based immigration is the most common form of immigration to the United States.

Student Visas
F-Academic Students and M-Vocational Students Requirements

Foreign students seeking to study in the U.S. may enter with F-1 or M-1 category provided they meet the following criteria: The student must be enrolled in an “academic” educational program, a language-training program, or a vocational program;

The school must be approved by U.S. Citizenship and Immigration Services (USCIS);

The student must be enrolled as a full-time student at the institution;

The student must be proficient in English or be enrolled in courses leading to English proficiency;

The student must have sufficient funds available for self-support during the entire proposed course of study; and

The student must maintain a residence abroad which he/she has no intention of giving up.
